         Tiekėjas, norėdamas iki pirkimo sutarties sudarymo teisme ginčyti Įgaliotosios organizacijos sprendimus ar veiksmus, turi pateikti pretenziją Įgaliotajai organizacijai Viešųjų pirkimų įstatymo VII skyriuje nustatyta tvarka. Įgaliotosios organizacijos sprendimas, priimtas išnagrinėjus tiekėjo pretenziją, gali būti skundžiamas teismui Viešųjų pirkimų įstatymo VII skyriuje nustatyta tvarka.

         Įgaliotoji organizacija nagrinėja tik tas tiekėjų pretenzijas, kurios gautos iki pirkimo sutarties sudarymo dienos ir pateiktos laikantis Viešųjų pirkimų įstatymo VII skyriuje nustatytų terminų.
